TERMS AND CONDITIONS OF THE DEKORT MEBLE ONLINE STORE

  1. Definitions

  1. Customer – A natural person, legal entity, or organizational unit without legal personality, which is granted legal capacity by special regulations, placing an Order within the Store.
  2. Consumer – A natural person performing a legal act not directly related to their business or professional activity (Article 221 of the Civil Code).
  3. Seller – Grupa Damian Zięba, Plac Targowy 13, 37-300 Leżajsk, NIP: 794-172-09-19, registered in the Central Registration and Information on Business Activity.
  4. Terms and Conditions – These regulations for the provision of electronic services within the online store www.dekort-furniture.com.
  5. Online Store (Store) – The website available at www.dekort-furniture.com, through which the Customer can place Orders.
  6. Goods – Products presented in the Store.
  7. Order – A declaration of intent by the Customer aimed at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
  8. Order Processing Time – The period from the acceptance of the Order to its preparation and handover for delivery.
  9. Sales Agreement – A sales contract for the Goods within the meaning of the Civil Code, concluded between the Seller and the Customer via the Store.
  1. General Provisions

  1. These Terms and Conditions define the rules for using the online store available at www.dekort-furniture.com.
  2. The Customer is required to read and accept the Terms and Conditions before placing an Order.
  3. The Terms and Conditions constitute the document referred to in Article 8 of the Act on the Provision of Electronic Services. They can be downloaded and printed.
  4. By placing an Order, the Customer accepts these Terms and Conditions and consents to the processing of personal data in accordance with applicable laws, including the GDPR.
  1. Personal Data Protection

  2. Personal data is processed in accordance with the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council), the Personal Data Protection Act, and other applicable legal regulations.
  3. The Customer has the right to:
    • Access, rectify, delete, or restrict the processing of their data.
    • Object to data processing and request data portability..
    • Lodge a complaint with the supervisory authority (President of the Personal Data Protection Office) if their rights are violated.
  4. Providing personal data is voluntary but necessary for order fulfillment. Data may be shared with third parties for the purpose of delivery or payment processing.
  1. Terms of Electronic Services Provision

  1. The Store provides electronic services, enabling Customers to place Orders. These services are free of charge and available to Customers with internet access.
  2. The agreement for the provision of electronic services is concluded when the Customer starts using the Store and remains in effect until the Customer ceases to use the services.
  3. The Customer agrees to use the Store in compliance with applicable laws, these Terms and Conditions, and principles of social conduct.
  1. Procedure for Concluding a Sales Agreement

  1. To conclude a Sales Agreement, the Customer selects the Goods, adds them to the cart, and fills out the Order form.
  2. The Customer has the opportunity to review and modify the data before placing the Order.
  3. The Order is placed after the acceptance of the Terms and Conditions and clicking the “Buy and Pay” button.
  4. The Sales Agreement is considered concluded at the moment the Order is confirmed by the Seller.
  5. In the event of a gross pricing error (e.g., due to a system glitch or human error), the Seller reserves the right to withdraw from the Sales Agreement based on Article 84 § 1 of the Civil Code. The Customer will be immediately informed of the situation and will receive a full refund of any payments made.
  1. Order Fulfillment

  1. The Seller processes Orders in the order they are received, in accordance with the information provided on the product page.
  2. If the Order cannot be fulfilled within the specified timeframe, the Customer will be immediately informed
  3. The colors of materials displayed in the Store may differ from the actual ones due to computer hardware settings. Upon request, the Customer may order free material samples, which must be returned.
  1. Delivery

  1. The Goods are delivered to the address specified by the Customer. The delivery costs are clearly stated during the Order placement process.
  2. If there is visible damage to the packaging or Goods upon delivery, the Customer is required to inspect the Goods in the presence of the carrier and prepare a damage report. This report is a necessary document for filing a claim regarding transport-related damages.
  3. The delivery time is between 1 to 7 business days from the moment the Order is shipped.
  4. The Seller is not responsible for delays caused by the carrier.
  1. Prices and Payment Methods

  1. The prices of Goods are listed in Polish zloty (PLN) and include VAT.
  2. The Customer can choose from the following payment methods:
    • Bank transfer
    • Online payment / instant transfers
    • Credit or debit card (Visa, MasterCard)
    • Cash on delivery (only upon prior agreement)
  1. Warranty for Defects

  1. The Seller is responsible for physical and legal defects of the Goods. The Customer has the right to request repair, replacement, price reduction, or withdrawal from the contract.
  2. Natural characteristics of wood, such as knots, variations in grain, color differences, or minor cracks resulting from the material’s natural properties, are not considered defects and are not subject to complaints. These elements are an integral part of wooden products, highlighting their authenticity and natural character.
  3. Claims under the warranty for defects expire after two years from the date of delivery of the Goods.
  1. Withdrawal from the Contract

  1. The Consumer has the right to withdraw from the contract within 14 days from receiving the Goods, without providing a reason.
  2. In the event of withdrawal, the Seller will refund all received payments, including delivery costs, within 14 days from receiving the withdrawal statement.
  3. The Consumer bears the direct cost of returning the Goods.
  4. The Goods must be returned in an undamaged condition, and the Consumer is responsible for any decrease in value resulting from improper use.
  1. Complaints and Irregularities

  1. Complaints can be submitted in writing to the Seller’s address or via email at sklep@dekort-furniture.com.
  2. The complaint should include: name, email address, description of the irregularity and the Order number.
  3. The Seller will review the complaint within 14 days from the date of receipt.
  1. Contract Withdrawal Form

  1. Final Provisions

  1. Disputes between the Consumer and the Seller shall be settled by competent courts in accordance with the provisions of the Code of Civil Procedure.
  2. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other applicable laws shall apply.
